Mascotas – Pet policy

General

 Only Home Owners, whose names are transcribed in the deed of ownership may be allowed to have pets in their condominium. Relatives, renters or their employees cannot, under any circumstances, keep pets in their condominium.

 Permissible Pets

 Owners will be allowed to have one (1) pet per condominium. Pets permitted shall be limited to the following: dogs, cats, birds and small caged animals such as guinea pigs and hamsters. In case of dogs, only medium sized dogs (maximum 25kg/55lbs) shall be permitted.

 Screening/Registration 

 Before bringing the pet to the condominium owners must complete a Pet Application Form, which can be downloaded from the KOAI website and submitted to the Administrator. The Pet Application Form will present the owner with the pet policy for acceptance and signature. Thereafter, the Administrator will forward the request to the Vigilance Committee for approval.

 If the pet is a dog or a cat, a current photograph should be attached as well as a copy of the pet’s health certificate (copy of the annual shot record).

 Restrictions 

 1. Pets must be confined to the owner’s unit.

 2. Pets must not be left unattended on any private outdoor areas (i.e. balconies and solariums).

 3. If the pet is a dog or a cat, owners will have their pet on a leash at all times in all common passage areas including stairs, walkways, garage, and driveway.

 4. Pets will not be allowed at the pool and any of the garden areas.

 5. If the pet is a dog or a cat, they are not permitted to urinate or defecate in any of the common areas and must remain outside the property lawn and garden to prevent the deterioration of the plants and grass.

 6. Owners are responsible for immediately and properly cleaning up after their pets.

 7. Cat litter may not be disposed of in toilets.

 8. No pet waste may be dropped in trash bins unless securely double-bagged.

 9. Owners are responsible for any damage caused by their pets.

 10. Pets shall not be kept to breed or used for any commercial purpose.

 11. No pet shall be allowed to become a nuisance or create any unreasonable disturbance:

a. Pets who make noise (especially bark) continuously and/or incessantly for a period of five (5) minutes or more per the disturbance of any person at any time of day or night.

b. Pets whose unruly behavior causes property damage.

c. Pets in common areas who are not on a hand-held leash.

d. Pets who relieve themselves on walls, floors, or plants of common areas.

e. Pets who exhibit aggressive behavior.

 Policy Enforcement/Removal of Pet

 1. Owners agree to a three (3) months’ probation period starting on the day they will bring their pet to the condo;

 2. Any owner found violating up to 5 individual policies or a single policy 3 times will result in the eviction of their pet.

 3. A fine will be imposed upon the owner for violation of any of these rules. Owners will be assessed the following for pet violations:

 First offense:                  $500 pesos fine

Second offense:            $1,000 pesos fine

Third offense:                $2,000.00 pesos fine

Subsequent offenses:   $4,000.00 pesos fine and potential removal of the pet from the property.

 Further, no non-registered pets will be allowed in condominiums (owners, owners’ relatives, renters or their employees). In case a non-registered pet is brought to a condominium a fine of 500 pesos per day, for the duration of the stay, will be enforced on the owner.

 4. Any owner, administrator or personnel witnessing a violation of any of these rules must send a written complaint (including date, time, and violated rule) to the Vigilance Committee for review.

 If the Vigilance Committee is in agreement with such complaint a written notice will be sent to the pet owner setting forth the provision of this Pet Policy violated and the amount of applicable fine imposed. Such fine shall subsequently become immediately due and payable and its imposition shall not be subject to challenge by the owner.

 If it is determined that the pet must be removed, the owner will be given 30 days to remove the pet from the property. If the pet is not removed by the deadline, a subsequent fine of 500 peso per day will be charged to the owner.

 Should legal action be required to remove an animal from a condominium the owner shall be responsible for all costs associated with the removal, including legal fees.

 Further, all fines, costs and expenses necessary to enforce this resolution will be levied against the condominium owner and shall be an assessment against the owner’s property and subject to all liens and collections power of the Home Owners’ Association.

 5. Every pet owner accepts and agrees with the strict enforcement of the established rules without any exceptions.

 Owners Selling their Property

 All Home Owners agree that, when selling their condominium, they will inform the potential buyer of the established pet policy so the buyer will be aware of its rules and regulations before considering purchasing the property.

 In addition, owners will provide the Administration with a formal document signed by any potential buyer stating that they have read, understood, and accepted the rules and regulations presented to them and that they will comply with them.
